All “OFFICINA BERNARDI®” jewelry items, when accompanied by their respective Certificate of Warranty and Authenticity, are covered by a warranty (the “Warranty”) that can be activated under the conditions set out below. “Customer” refers to anyone who has purchased an “OFFICINA BERNARDI®” product from an authorized retailer or from the website www.officinabernardi.com.
SCOPE OF THE WARRANTY
“OFFICINA BERNARDI®” jewelry (the “Products”) is warranted against original defects arising from its design and/or manufacture or from the quality of the materials used in its production (“Defects”). If a Customer reports a Defect and such Defect is verified according to the procedures described herein, the Customer is entitled to have the Product repaired or, if repair is impossible or excessively burdensome, to have it replaced. If replacement is not possible (for instance, if the item is discontinued), the Product will be replaced with a similar item of equal or greater value.
During the Warranty period, Customers may report any Defects either by contacting the retailer where the Product was purchased or by sending an email to customercare@officinabernardi.com
. For the purpose of assessing the applicability of the Warranty and determining the nature and extent of the Defect, Customers may be asked to provide photographic documentation or to use videoconferencing tools.
If, as with online purchases, the Product needs to be shipped to the destination indicated to the Customer, all related shipping costs will be borne entirely by the Customer. Repair of a Product for which a Defect has been verified will be carried out within a reasonable timeframe based on the extent of the Defect. In the case of replacement, the defective Product will be collected.
CONDITIONS FOR WARRANTY COVERAGE
The Warranty does not apply if the purchase price of the Product has not been paid in full. However, if payment is scheduled in installments, the Warranty becomes active immediately and remains valid as long as all payments are made on time.
The Warranty does not apply if the Customer is unable to prove the authenticity of the Product by presenting the Certificate of Warranty and Authenticity or other proof of purchase (receipt/invoice) from an authorized retailer or from www.officinabernardi.com.
WARRANTY DURATION
Unless otherwise extended, the Warranty is valid for 2 (two) years from the date of purchase of the Product. The “date of purchase” refers to the date indicated on the Certificate of Warranty and Authenticity or on the fiscal documentation issued at the time of purchase.
EXCLUSIONS AND LIMITATION OF LIABILITY
The Warranty does not cover Defects arising from the following:
Negligence and/or improper care in the use of the Product;
Tampering, unauthorized maintenance, or interventions by unauthorized personnel;
Improper or abnormal use of the Product, or storing it in excessively hot, cold, dusty, or chemically aggressive environments due to chlorine, lacquers, paints, or other chemical and/or toxic agents—unless such conditions were documented prior to purchase and Product tolerance to such environments was guaranteed;
Worsening of damage resulting from continued use of the Product after the Defect has appeared;
Accidental events, force majeure, including freezing, overheating, fire, theft, natural events, vandalism, accidents, and similar occurrences.
This Warranty represents the only obligations undertaken by the seller or manufacturer in the event that a Product is found to be defective. Any further liability, including for indirect damages caused by the defectiveness of a Product, is expressly excluded.
